
Rule 198. Failure to file inventory or account
If any executor or administrator shall fail to file an inventory or an account when such inventory or account is due under the provisions of these rules, the clerk shall issue forthwith and cause to be mailed to the executor or administrator and to his attorney or attorneys of record a notice directing attention to the fact that the inventory or account is overdue and directing that the required papers be filed forthwith. If the required papers shall not be filed within 15 days after the mailing of such notice, the clerk shall issue against the executor or administrator and his attorney or attorneys of record a citation to appear in open court on a day certain to show cause why they and each of them should not be punished as for contempt of court. Each of the cited persons shall incorporate in a written and verified return any justification or excuse he may have for the delay complained of. He shall also appear personally in court on the return day.--Added Dec. 17, 1976.
