Arraignment is a court proceeding whereby the defendant is brought before the Court to plead to the criminal charge against him or her. In accordance with Superior Court Rule 125, arraignment is conducted in open court and, unless waived by the Defendant, shall consist of the reading of the complaint to the defendant or stating to him the substance of the charge and calling on him to plead thereto.
Where the defendant has not been served with a copy of the complaint, the judge shall give him the complaint for the purpose of examining and reading it before he or she is called to plead.
